RELEASE OF LIABILITY, WAIVER OF CLAIMS & INDEMNITY AGREEMENT
BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

IN CONSIDERATION OF the membership of the club named in this membership registration (the “Member Club”) in the CANADIAN OUTRIGGER RACING ASSOCIATION (“CORA”) and permission to participate in the sanctioned events of CORA hosted by CORA and its member clubs between and including January 1, 2024 and December 31, 2024 (the “Events”), the Member Club hereby acknowledges and agrees as follows:

AWARENESS AND ASSUMPTION OF RISK: The Member Club confirms that it is aware that its participation in the Events involves risks inherent in paddling sports, both on and off the water, including risk of personal injury, death, property damage, expense and related loss, including, without limitation, loss of income and such risks arising from the negligence of CORA and its member clubs and/or other participants and owners of the facilities where the Events will occur and their respective directors, officers, officials, employees and volunteers (collectively, the “Hosts”) and from other Event participants. The Member Club confirms that the Hosts make no representations as to participants’ safety during the Events or the condition of any canoes or equipment provided for the Events. The Member Club freely accepts and fully assumes all such risks and the possibility of personal injury, death, property damage, expense and related loss, including loss of income.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY: In consideration of the Hosts allowing the Member Club to participate in the Events, the Member Club hereby agrees:

1. to waive any and all claims that it may have in future against the Hosts arising from its participation in the Events;
2. to release the Hosts from any and all liability for any personal injury, death, property damage, expense and related loss, including loss of income that it may suffer as a result of its participation in the Events, due to any cause whatsoever, including the Hosts’ negligence, breach of contract or breach of any statutory duty of care; and
3. to hold harmless and indemnify the Hosts from any and all liability for any damage to property of, or personal injury to, any third party, resulting from its participation in the Events, even if due to the Hosts’ negligence, breach of contract or breach of any statutory duty of care.

GENERAL PROVISIONS: This Agreement shall be binding on not only the Member Club, but its successors and assigns. If any provision of this Agreement is held invalid or unenforceable, it will be severed herefrom and will not affect the validity or enforceability of the remainder hereof. This Agreement sets out the entire agreement between the parties regarding the subject matter hereof and may not be amended. This Agreement shall be governed by the laws of British Columbia, Canada.

I CONFIRM THAT I AM AN AUTHORIZED SIGNATORY FOR THE MEMBER CLUB AND HAVE BEEN AUTHORIZED TO AGREE ON BEHALF OF THE MEMBER CLUB TO THE TERMS AND CONDITIONS SET OUT HEREIN. I ACKNOWLEDGE THAT THE MEMBER CLUB HAS BEEN GIVEN THE OPPORTUNITY TO CONSULT A LAWYER FOR INDEPENDENT LEGAL ADVICE.
